Copyright Complaint Policy

1. Intellectual Property Ownership

All core platform source code, database structures, page designs, stylesheets, scripts, templates, and trademarks displayed on DigiVite.in belong exclusively to DigiVite or our respective licensing partners. Users retain intellectual property ownership of the event-specific details, personal photography, and audio files they upload to their invitations.

2. User Responsibility & Intermediary Safe Harbor

DigiVite complies with the Indian Copyright Act, 1957 and acts as an Intermediary under Section 79 of the Information Technology Act, 2000. We do not preview or monitor custom music tracks or photographs uploaded by users. We require all hosts to verify that they possess appropriate distribution licenses or ownership rights before uploading background music tracks, professional photography, or trademarked logos to their event invitations.

3. Copyright Grievance Procedure

If you are a copyright owner or an authorized agent thereof and believe that any content hosted on our platform infringes upon your copyright, you may submit a written complaint to our designated Grievance Officer. Your notification must include:

  • A physical or electronic signature of the copyright owner or authorized representative.
  • Identification of the copyrighted work claimed to have been infringed (such as links to the original work or registration certificates).
  • Identification of the infringing material hosted on our domain, including the specific invitation URL (e.g. https://digivite.in/invite/our-wedding).
  • Your contact details, including physical mailing address, phone number, and email.
  • A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner.

4. Action Upon Notification & Take-Down

Upon receiving a valid, compliant infringement notice, we will temporarily remove or disable access to the infringing material within 36 hours in compliance with the Information Technology Rules, 2021. We will notify the hosting user who uploaded the material. Recurring violations by specific hosts will lead to account suspension in compliance with our Terms of Service.

5. Counter-Notification

If you believe your content was removed in error or as a result of misidentification, you may submit a counter-notice containing your signature, identification of the removed file, a statement that you have the right to host the content, and your consent to local jurisdiction in Mumbai, Maharashtra, India. Send counter-notices to compliance@digivite.in.
