1. Agreement to Terms
By registering an account, purchasing digital template access, buying subscription passes, or accessing any service on DigiVite.in ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you are prohibited from using our platform, customizing templates, or distributing digital invitations.
2. User Eligibility & Account Registration
In compliance with the Indian Contract Act, 1872, you must be at least 18 years of age and competent to enter into a legally binding contract to register an account. You agree to provide accurate and complete registration data. You are solely responsible for protecting your account passwords and maintaining access permissions. We reserve the right to suspend or terminate accounts that violate our security measures or represent a risk to other users.
3. Product Tiers, Pricing, & Subscriptions
DigiVite.in offers template access and subscription passes under the following rules:
A. Free Templates
Free templates are free forever. Users can customize, publish, and host their digital invitations without making a payment. Free cards display default platform branding.
B. Single Template Access
Purchases grant access to edit and host a specific paid template for a validity window of 120 days. Pricing varies by template tier:
- Premium Templates: âš199 (includes interactive RSVPs and standard paid layouts). Renewal pricing is âš99 for 1 month or âš249 for 3 months.
- Elite Templates: âš499 (includes luxury animations, guestbooks, and custom media uploads). Renewal pricing is âš199 for 1 month or âš499 for 3 months.
C. Subscription Passes
Subscription passes unlock access to all templates within the chosen tier for a period of 120 days:
- Premium Pass (âš699): Grants unlimited creation and hosting of all Premium templates.
- Elite Pass (âš1,499): Grants unlimited creation and hosting of all Premium and Elite templates.
4. User Uploads, RSVP Collection, & Intellectual Property
You retain intellectual property ownership of all custom text, event photos, and background music (MP3) files you upload. By posting content to our platform, you grant DigiVite a non-exclusive, worldwide, royalty-free license to host, parse, and display your assets solely for rendering your digital invitations (e.g., at https://digivite.in/i/{slug}).
You are solely responsible for ensuring you have appropriate rights to the files you upload (including background audio tracks). Under the Information Technology Act, 2000, DigiVite acts as an intermediary and is not liable for user-uploaded content. We reserve the right to remove infringing content upon receiving valid complaints as detailed in our Copyright Complaint Policy.
For guest management and RSVP collection, you act as the primary Data Fiduciary. You represent that you have obtained appropriate consent from your guests to collect their attendance status, headcount, and guest names prior to inviting them.
5. Affiliate Program
Users who participate in our promotional referral program agree to comply with our dedicated Affiliate Agreement. Prohibited spam, self-purchasing fraud, or search engine keyword bidding will lead to immediate account suspension and forfeiture of commission balances.
6. Limitation of Liability
DigiVite.in is provided on an "as is" and "as available" basis. While we maintain a high platform uptime, we are not responsible for delivery failures caused by internet outages, incorrect guest contact info, or third-party mailing blocks. Our total liability is limited to the fees you paid us during the 12-month period preceding any claim.
7. Governing Law & Dispute Resolution
These terms and conditions are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
